Many civil claims in Alberta are subject to a limitation period, but certain claims arising from sexual misconduct, or from assault or battery within an intimate or dependent relationship, may not be subject to the usual period. The firm reviews each claim against these rules early on, because the answer determines whether and when a Statement of Claim should be filed.
Procedurally, a claim of this nature is advanced as a separate civil action, filed by Statement of Claim under Part 3, Division 3 of the Alberta Rules of Court. Where a family file is already underway, the civil claim is indicated on the Request for Mandatory Intake Triage (MIT) Conference Form. The firm manages this sequencing so that the civil and family tracks work together rather than against each other.
